Welcome to Daily Dua. These Terms and Conditions ("Terms") govern your access to and use of the Daily Dua mobile application (the "App"), operated by Lunaire Labs LLC ("Company," "we," "us," or "our"), a business entity located at 30 N Gould St, Wyoming, United States of America.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Daily Dua is available to users of all ages. However, children under the age of 13 require parental or guardian consent to use the App. By using Daily Dua, you represent that you have the legal capacity to enter into these Terms. If you are a minor, you represent that you have obtained parental or guardian consent to use Daily Dua. We do not knowingly collect personally identifiable information from children under 13 without such consent.
Daily Dua is a mobile application designed to help users find Quranic verses that match their mood and feelings. Users may upload text to describe how they are feeling, and the App will suggest relevant Quranic verses. Users may also upload personal notes for their own use within the App.
You may input text content to the App, including personal notes and descriptions of your feelings ("User Content").
3.1 Local storage. Unlike standard apps that store data on company servers, Daily Dua is designed to be "Local-First." Your User Content is stored locally on your device. We do not store, view, or have access to your specific User Content on our servers.
3.2 Responsibility. Because your content is stored locally on your device, you are solely responsible for your data. We are not liable for any loss of User Content resulting from device loss or deletion of the App.
4.1 Subscription plans. Daily Dua offers subscription plans that provide access to premium features. Subscription details, including pricing and features, are available within the App.
4.2 Free trial. We offer a 7-day free trial for new subscribers. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
4.3 Auto-renewal. All subscriptions automatically renew at the end of each subscription period unless you cancel your subscription before the renewal date. You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings, depending on your device. Cancellation will take effect at the end of the current billing period.
4.4 Payment processing. All payments are processed through your app store provider (Apple App Store or Google Play Store) and our payment processing partner, RevenueCat. By subscribing, you agree to the payment terms presented at the time of purchase. We do not store your payment information directly.
4.5 Refunds. Refund requests are subject to the policies of the platform where you made the purchase:
The App and all of its content, features, and functionality, including but not limited to the logo, visual design, trademarks, text, graphics, images, software, and other materials (collectively, "Our Content"), are the exclusive property of Lunaire Labs LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not copy, modify, distribute, sell, lease, or create derivative works based on Our Content without our prior written consent. Your use of the App does not grant you any ownership rights in Our Content.
If you provide us with any feedback, suggestions, ideas, or recommendations regarding the App ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such Feedback for any purpose without compensation, credit, or acknowledgment to you.
You agree not to:
8.1 Account termination. We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice, including but not limited to if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if your continued use of the App poses a risk to us or other users.
Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.
8.2 Deletion process and grace period. You may initiate the deletion of your account and data within the App settings. To prevent accidental loss of your reflections, we implement a 14-day safety grace period:
8.3 Subscriptions. Important: Initiating account deletion does not automatically cancel your subscription. You must manually cancel your subscription through your Apple App Store or Google Play Store settings to avoid future charges.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
The Quranic verses and content provided through the App are for informational and spiritual purposes only and should not be considered as professional advice of any kind.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUNAIRE LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Lunaire Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your User Content, or your violation of these Terms.

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the App that cannot be resolved informally shall be resolved by binding arbitration, rather than in court. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association ("AAA") then in effect. The arbitration shall take place in California, United States of America, and the arbitrator's decision shall be final and binding.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO A JURY TRIAL.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing Support@lunairelabs.com with your name, address, and a clear statement that you wish to opt out of the arbitration agreement.
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Wyoming.

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by posting the updated Terms within the App and updating the "Last updated" date above. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lunaire Labs LLC regarding your use of the App and supersede all prior agreements and understandings, whether written or oral.
