Welcome to Align. These Terms and Conditions ("Terms") govern your access to and use of the Align mobile application (the "App"), operated by Lunaire Labs LLC ("Company," "we," "us," or "our"), a business entity located at 30 N Gould St, Wyoming, United States of America.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
The App is available to users of all ages. By using the App, you represent that you have the legal capacity to enter into these Terms, or if you are a minor, that you have obtained parental or guardian consent to use the App.
Align is a mobile application designed to help users measure, track, and reduce implicit bias through the use of Implicit Association Tests (IAT). Users take timed sorting assessments to generate a "Mindset Card" that visualizes their bias metrics across various categories (including race, gender, sexuality, and disability). The App provides tracking tools to monitor progress over time.
When you use the App, we generate and store data based on your interactions, including your IAT scores, reaction times, and Archetype assignments ("User Content"). Your User Content is strictly private and intended solely for your personal use and self-improvement. We do not share, sell, or distribute your specific test results to third parties except as required by law or as described in our Privacy Policy.
You acknowledge that the results generated by the App are based on algorithmic analysis of your reaction times and are provided for educational purposes.
The App offers subscription plans that provide access to premium features, including advanced analytics and historical tracking. Subscription details, including pricing and features, are available within the App.
We offer a 7-day free trial for new subscribers. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
All subscriptions automatically renew at the end of each subscription period unless you cancel your subscription before the renewal date. You may cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period.
All payments are processed through Apple's App Store and our payment processing partner, RevenueCat. By subscribing, you agree to the payment terms presented at the time of purchase. We do not store your payment information directly.
Refund requests are subject to Apple's refund policies. To request a refund, please contact Apple directly through their App Store support.
The App and all of its content, features, and functionality, including but not limited to the logo, visual design, trademarks, text, graphics, images, software, and other materials (collectively, "Our Content"), are the exclusive property of Lunaire Labs LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not copy, modify, distribute, sell, lease, or create derivative works based on Our Content without our prior written consent. Your use of the App does not grant you any ownership rights in Our Content.
If you provide us with any feedback, suggestions, ideas, or recommendations regarding the App ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such Feedback for any purpose without compensation, credit, or acknowledgment to you.
You agree not to:
(a) Use the App for any unlawful purpose or in violation of any applicable laws or regulations;
(b) Upload any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable;
(c) Attempt to gain unauthorized access to the App, other users' accounts, or any systems or networks connected to the App;
(d) Interfere with or disrupt the App or servers or networks connected to the App;
(e) Reverse engineer, decompile, or disassemble the App;
(f) Use any automated means to access or collect data from the App.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice, including but not limited to if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if your continued use of the App poses a risk to us or other users.
Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
The assessments, Mindset Cards, and content provided through the App are for educational, informational, and self-awareness purposes only. They are not intended to be a substitute for professional psychological advice, diagnosis, or treatment. You should not interpret your results as a definitive statement on your character or moral standing.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUNAIRE LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Lunaire Labs LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your User Content, or your violation of these Terms.

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the App that cannot be resolved informally shall be resolved by binding arbitration, rather than in court. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association ("AAA") then in effect. The arbitration shall take place in California, United States of America, and the arbitrator's decision shall be final and binding.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO A JURY TRIAL.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing Support@lunairelabs.com with your name, address, and a clear statement that you wish to opt out of the arbitration agreement.
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in California.
The App may integrate with third-party services, including RevenueCat for payment processing and Supabase for backend services. Your use of such third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
The following terms apply to your use of the App if you downloaded it from the Apple App Store:
(a) These Terms are between you and Lunaire Labs LLC only, and not with Apple Inc. ("Apple"). Lunaire Labs LLC, not Apple, is solely responsible for the App and its content.
(b) Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
(c) Lunaire Labs LLC, not Apple, is responsible for providing any maintenance and support services for the App.
(d) In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
(e) Lunaire Labs LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
(f) In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Lunaire Labs LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
(g) Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by posting the updated Terms within the App and updating the "Last Updated" date above. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lunaire Labs LLC regarding your use of the App and supersede all prior agreements and understandings, whether written or oral.
